Terms of service
The terms on which DishMark provides menu and price benchmarking reports.
What we provide
DishMark provides reports describing information observed on publicly published food-service menus within an area you select. Reports describe observed menus, not sales. They do not measure the number of items sold, customer demand, or the financial performance of any establishment.
We do not warrant that a report covers every establishment within a selected area. Each report states how many establishments were discovered, how many were checked, how many published a readable menu, and the reason any establishment is absent from the figures.
Your use of reports
You may use reports internally, including in commercial decision-making, and may share them with the recipients configured on your account. You may not resell reports, republish them in substantial part as your own product, or present DishMark figures as the output of your own collection.
If you quote a figure externally, cite DishMark and the report date. Figures move, and an uncited figure cannot be verified.
Accuracy and corrections
Every reportable figure carries a source URL, a retrieval timestamp and an evidence locator. If you believe a figure is wrong, tell us which figure and we will re-check it. Where a correction is warranted we will apply it and record that it was applied.
We do not infer or estimate prices that an establishment has not published. We do not infer allergen information, which is the legal responsibility of the establishment.
Availability
We aim to make the portal continuously available, and scheduled reports run to their cadence. Collection depends on third-party websites, which change and sometimes become unavailable. Where collection fails, the report says so rather than substituting an estimate.
Termination
You may cancel a monitoring plan at any time; it will run to the end of the paid twelve-month period unless you ask otherwise. We may suspend an account for non-payment, or for use that breaches these terms.
